General provisions

  1. These Terms and Conditions set out the general terms, conditions, and manner of sale by Raiseberry Magdalena Jurek-Karasek, with its registered office at ul. Polna 5, 44-340 Godów, NIP: 8652506296, via the online store https://www.mkmaryla.pl (hereinafter referred to as the "Store"), where Products offered by the Store are sold via the Internet.
  2. The Seller is responsible for the content posted on the Online Store's website.
  3. The Seller can be contacted via the website https://mkmaryla.pl, this link containing the e-mail address biuro@mkmaryla.pl, or by phone at +48 32 307 22 21 (Mon-Fri 9:00 a.m.-4:00 p.m.). Direct contact is also possible at the Company's headquarters, i.e. 44-340 Godów, ul. Polna 5 (Mon-Fri, 8:00 a.m.-3:00 p.m.).
  4. Definitions: Business

    Customer - a natural person, legal person or organizational unit without legal personality, but having legal capacity, using the Online Store, to whom, in accordance with the Terms and Conditions and the provisions of law, services may be provided electronically or with whom a Sales Agreement may
    be concluded Consumer - a natural person performing a legal transaction with an entrepreneur not directly related to their business or professional activity
    Supplier: means an entity with which the Seller cooperates in the delivery of Goods:
    - a courier
    company - Poczta Polska SA (
    Polish Post) Products - goods presented in the Store, the description of which is available for each of the products presented and which may be the subject of a sales contract
    Order - a declaration of will by the Customer, aimed directly at concluding a sales contract, specifying in particular the type of goods and their quantity.
    The contract for the sale of Products offered through the Online Store is concluded upon confirmation of the Customer's order by the Seller. If the order cannot be fulfilled, the Customer will be immediately notified by e-mail, indicating the reasons and the possibility of its fulfillment.
  5. The place of delivery of Products purchased through the Online Store is exclusively the territory of the Republic of Poland.
  6. To browse the Online Store's website, including browsing the Online Store's assortment, a device with Internet access and a web browser such as Internet Explorer, Microsoft Edge, Google Chrome, Mozilla Firefox, Opera, or Safari in the current version is required.

Information about Products and their prices

  1. Information about Products available in the Online Store's assortment constitutes an invitation to conclude a contract within the meaning of Article 71 of the Civil Code.
  2. All information regarding the essential characteristics of the Products and their prices is published by the Seller on the Online Store's website.
  3. The Seller shall make every effort to ensure that the descriptions of the Products posted on the Online Store's website are accurate and correspond to the stock levels. If all or part of the Product covered by the order is unavailable, the Seller shall immediately notify the Customer thereof, at the same time informing them about the possibility of accessing the Product in the future, and if payment has been made, the Seller shall refund the Customer the entire purchase price received from them.
  4. A limited number of Products are available for sale, including promotional sales and clearance sales, and orders are fulfilled in the order in which confirmed orders for these Products are received, until the stock covered by this form of sale is exhausted.
  5. The prices of Products indicated on the Store's website: are
    given in Polish zlotys and include VAT,
    do not include delivery costs, delivery costs depend on the method of delivery of the Product to the Customer; The total cost of the order (i.e., the price of the products plus delivery costs) is indicated in the Shopping Cart before the Customer places the order.
  6. The price indicated for each Product is binding at the moment the Customer places an order in the Online Store by selecting the "Order with obligation to pay" option. Upon clicking this button, the Customer is obliged to pay the price for the Product. Detailed payment methods and terms depend on the method of payment and method of delivery selected by the Customer when placing the order.
  7. The Seller reserves the right to make ongoing changes to the prices of Products in its offer, to introduce and cancel promotional prices, or to make changes to them. The right referred to in the previous sentence does not affect orders placed before the date on which the price change comes into effect.
  8. The Seller may conduct promotional campaigns and sales on separately specified terms.

Terms and conditions for placing and fulfilling orders 

  1. The Customer may place orders via the Online Store 7 days a week, 24 hours a day, throughout the year, except for technical breaks specified in an information message posted on the Store's website and subject to trade prohibitions or restrictions resulting from mandatory provisions of law.
  2. In order to place an order, you must:
    log in to the Online Store or use the option to place an order without registration,
    select the Product to be ordered (its type, model, style, size, accessories, quantity) by adding the selected Product to the basket by clicking the "Add to cart" button,
    select the delivery method (method of delivery of the Product),
    enter the details of the recipient of the order and the address to which the Product is to be delivered, as well as provide a telephone number and e-mail address for contact regarding the order,
    enter the invoice details, if different from the order receipt details (if the Customer is to be issued a VAT invoice),
    select the payment method,
    click the "Order with obligation to pay" button, whereby the Customer confirms the details provided by them necessary for the performance of the contract and undertakes to pay the price indicated in the order for the ordered Products
  3. Before sending the order, the Customer has the opportunity to recheck and possibly modify all data.
  4. If the Customer provides incorrect or inaccurate data in the order, including in particular an incorrect or inaccurate address, the Seller shall not be liable for non-delivery or delay in delivery of the item sold.
  5. The Seller reserves the right to withdraw from the order if it cannot be fulfilled or if the data provided by the Customer is incomplete or incorrect, which prevents the order from being properly executed, including, among other things, the correct addressing of the shipment. The Seller also reserves the right to withdraw from the contract before confirming the order without giving a reason. The Online Store will immediately notify the Customer of each withdrawal from the order, indicating the reason.
  6. The condition for placing an order is to read the Terms and Conditions available on the Online Store's website and accept its provisions, which the Customer confirms by clicking the "I accept the Terms and Conditions of the Online Store" button on the order form.
  7. Placing an order by the Customer means submitting an offer to the Seller to conclude a contract of sale (purchase) of the ordered Product. The contract of sale is concluded upon confirmation by the Seller of the acceptance of the order placed by the Customer, which means that at that moment the contract becomes legally effective. The Seller's acceptance of the order is confirmed when the Customer receives an e-mail with a statement of acceptance of the order for execution by the Seller.
  8. The delivery time for each order is up to 21 business days from the date of confirmation of acceptance of the order.
  9. A receipt is issued for each order, and a VAT invoice is issued at the Customer's request.
  10. After placing an order, the Seller sends
    the Customer to the e-mail address provided by them:- a message confirming receipt of
    the order along with the order number, - confirmation of acceptance of the order for execution, which constitutes the Seller's statement of acceptance of the offer.

Methods of payment and shipping of Products

  1. Orders placed in the MK Maryla Store can be paid for:
    in advance (before receiving the order) - by bank transfer via the external payment system PayU |
    cash on delivery - payment to the supplier upon receipt of the order,
    cash upon collection at the Seller's premises,
  2. Payment should be made within 7 days from the date of order
    acceptance,
    cash on delivery and upon collection - at the time of order collection.
  3. The ordered Product may be collected at the Seller's premises or delivered at the Customer's choice - via a postal operator or courier company in accordance with the delivery method selected by the Customer when placing the order, where the delivery cost is also specified, which the Customer accepts when choosing the delivery method.
  4. The Seller publishes information on the Online Store's website about the number of working days required for delivery and order fulfillment.
  5. Personal collection at the Seller's premises is possible from Monday to Friday between 8:00 a.m. and 4:00 p.m., after prior arrangement by telephone.
  6. When choosing delivery via a postal operator or courier company and cash on delivery - in the event of the Customer's absence at the address provided or lack of funds to pay for the shipment, the delivery company will leave a notification entitling the Customer to collect the shipment at a Polish Post Office or at a location designated by the courier company.
  7. In the case of payment in advance, the order will be processed after the Seller receives full payment.
  8. In the case of cash on delivery, the order will be processed after the Customer receives confirmation of acceptance of the order by the Seller.
  9. The Customer is obliged to inspect the delivered shipment in a timely manner and in a manner accepted for shipments of this type.
    If the shipment is found to be missing or damaged or otherwise non-compliant, the Customer has the right to request that the Supplier's representative draw up a report of the irregularities found.
    If the Product's packaging shows signs of damage or attempted opening, the shipment should be refused or its contents checked in the presence of the Supplier.
  10. If the Product does not comply with the order placed, the Customer should immediately contact the Online Store via e-mail at biuro@mkmaryla.pl or by phone at +48 32 307 22 21 to report the incorrect delivery of the Product or damage to the packaging.
